ORDINANCE 4-2004

ORDINANCE AMENDING CHAPTER V, ANIMAL CONTROL, OF THE MENDHAM TOWNSHIP ORDINANCE CODE

BE IT ORDAINED by the Township Committee of the Township of Mendham , in the County of Morris , New Jersey , as follows:

            Section 1.       Subsection 5-1.1, Definitions, of Chapter V, Animal Control of The Revised General Ordinances of the Township of Mendham, 1998 (the “Code”) is hereby supplemented with new definitions of “animal” and “owner of an animal” to read as follows (without any change to the existing definitions): 

“Animal shall mean any animal kept as a farm or domestic animal, including a dog.

Owner of an animal shall mean any person owning, keeping or harboring an animal.”

Section 2.  The title of Section 5-3, Control of Dogs, and Subsections 5-3.1 and 5-3.4 of the Code are hereby amended to read as follows:

“5-3     CONTROL OF ANIMALS

            5-3.1    Running at Large Prohibited.  No owner of an animal shall permit or suffer the animal to run at large within the Township at any time.

5-3.4    Penalty.          The General Penalty provisions of this Code shall apply to violations of this Section.  Each day that a violation of this Section continues shall be a separate violation.”

            Section 3.       This ordinance shall take effect after final passage and publication as provided by law.
