ORDINANCE   19 -2004

ORDINANCE APPROVING RELOCATION OF DRAINAGE EASEMENT ON BLOCK 100, LOT 34.04 IN THE TOWNSHIP OF MENDHAM

BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM , IN THE COUNTY OF MORRIS , NEW JERSEY , as follows:

Section 1.   Pursuant to N.J.S.A. 40A:12-5, the Mendham Township Committee hereby determines that a certain drainage easement on Block 100, Lot 34.04 in the Township of Mendham should be relocated on the same premises to avoid steep slopes and minimize land disturbance and because of the proposed location of the new dwelling.

Section 2.   Therefore, the Mendham Township Committee hereby approves the Drainage Easement Agreement which vacates the existing drainage easement in exchange for a new drainage easement on Block 100, Lot 34.04, and the Mayor and Township Clerk are hereby authorized and directed to execute and deliver the Drainage Easement Agreement on behalf of the Township.

Section 3.   The existing drainage easement and the new drainage easement are described in the Drainage Easement Agreement which is on file in the Township Clerk’s Office and available for inspection during regular business hours.

Section 4.   This ordinance shall take effect after final passage and publication as provided by law.
