TOWNSHIP OF MENDHAM

ORDINANCE  14  - 2004

            ORDINANCE VACATING THE PUBLIC RIGHTS IN CERTAIN PORTIONS OF GLENGARY DRIVE AND INDIAN HOLLOW ROAD IN THE TOWNSHIP OF MENDHAM

            WHEREAS, the Mendham Township Committee has determined that portions of Glengary Drive and Indian Hollow Road in the Township, previously dedicated to public use for street purposes, are no longer needed for public use, and the Committee now wishes to vacate the public rights in those portions of Glengary Drive and Indian Hollow Road;

            NOW, THEREFORE, BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM IN THE COUNTY OF MORRIS , NEW JERSEY , as follows: 

            Section 1.   The Township of Mendham, in the County of Morris, hereby vacates, releases, relinquishes and waives any and all public rights it may have arising by virtue of the dedication to public use for street purposes of all those certain lands situate, lying and being in the Township of Mendham, in the County of Morris and State of New Jersey, described as follows:

GLENGARY DRIVE :

Parcel “A”

DESCRIPTION OF ROAD VACATION IN FAVOR

OF BLOCK 139, LOT 46

TOWNSHIP OF MENDHAM                                             

MORRIS COUNTY , NEW JERSEY              

                                                                                   

All that certain parcel of land situate, lying and being in the Township of Mendham, in the County of Morris and the State of New Jersey, and being part of an unnamed road located off Glengary Drive as shown on Sheet Number 26 of the Official Tax Map of the Township of Mendham and being more particularly bounded and described as follows to wit:

BEGINNING at a point, in the easterly sideline of Glengary Drive 50 feet wide 632.83 feet measured along said sideline and the extension of said sideline from the northerly sideline of Mendham Road East – Route 24, 66 feet wide. thence, continuing northerly along said sideline of Glengary Drive

1.         53.75 feet along the arc of a curve deflecting to the right, having a radius of 900.00 feet, a delta angle of 3Ί25’18” and a chord bearing N 06Ί49’13”W, 53.74 feet to a point; thence, along Lot 46 in Block 139

2.         42.71 feet along the arc of a curve deflecting to the left, having a radius of 25.00 feet, a delta angle of 97Ί52’49” and a chord bearing S 54Ί02’59”E, 37.70 feet to a point; thence –

3.         N 77Ί00’37”E, 366.58 feet to a point; thence

4.         S 03Ί26’00”W, 26.06 feet to the centerline of the aforesaid unnamed road; thence, along said centerline.

5.         S 77Ί00’37”W, 389.75 feet to the point of BEGINNING

CONTAINING: 9,988 S.F, or 0.229 acres of land more or less.

Parcel “B”

DESCRIPTION OF ROAD VACATION IN FAVOR     

OF BLOCK 139, LOT 45

TOWNSHIP OF MENDHAM                                              

MORRIS COUNTY , NEW JERSEY              

                                                                                   

All that certain parcel of land situate, lying and being in the Township of Mendham, in the County of Morris and the State of New Jersey, and being part of an unnamed road located off Glengary Drive as shown on Sheet Number 26 of the Official Tax Map of the Township of Mendham and being more particularly bounded and described as follows to wit:

BEGINNING at a point, in the easterly sideline of Glengary Drive 50 feet wide 583.33 feet measured along said sideline and the extension of said sideline from the northerly sideline of Mendham Road East – Route 24, 66 feet wide. thence, continuing northerly along said sideline of Glengary Drive

1.         49.50 feet along the arc of a curve deflecting to the right, having a radius of 900.00 feet, a delta angle of 3Ί09’04” and a chord bearing N 10Ί06’24”W, 49.49 feet the centerline of the aforesaid unnamed road; thence, along said centerline.

2.         N 77Ί00’37”E, 389.75 feet to a point; thence –

3.         S 03Ί26’00”W, 26.06 feet to a point; thence

4.         S 77Ί00’37”W, 359.88 feet along Lot 45, Block 139; thence, continuing along said Lot

5.         38.70 feet along the arc of a curve deflecting to the left, having a radius of 25.00 feet, a delta angle of 88Ί41’33” and a chord bearing S 32Ί39’50”W, 34.95 feet to the point of BEGINNING

DESCRIPTION OF ROAD VACATION IN FAVOR    

OF BLOCK 142, LOT 44

TOWNSHIP OF MENDHAM                                                  

MORRIS COUNTY , NEW JERSEY              

All that certain parcel of land situate, lying and being in the Township of Mendham, in the County of Morris and the State of New Jersey, and being part of an unnamed road located as an extension of Indian Hollow Road ( formerly Lenape Way) 50 feet wide as shown on Sheet Number 31 of the Official Tax Map of the Township of Mendham and being more particularly bounded and described as follows to wit:

BEGINNING at a point, in the westerly sideline of Indian Hollow Road 3,435.68 feet measured along said sideline and the extension of said sideline from the southerly sideline of Green Hills Road (formerly Stone Axe Road ) thence; along Lot 44 in Block 142 the following two courses

1.          65.35 feet along the arc of a curve deflecting to the right, having a radius of 179.00 feet, a delta angle of 20Ί55’09” and a chord bearing N 18Ί02’30”W, 64.99 feet to a point of compound curvature; thence -

2.          242.94 feet along the arc of a curve deflecting to the right, having a radius of 293.00 feet, a delta angle of 47Ί30’23” and a chord bearing N 16Ί10’16”, 236.04 feet to Lot 29; thence; along said lot

3.          S 77Ί07’45”E, 28.42 feet to a point in the centerline of the aforesaid unnamed road; thence; along said centerline the following two courses

4.          235.14 feet along the arc of a curve deflecting to the left, having a radius of 268.00 feet, a delta angle of 50Ί16’16” and a chord bearing S 17Ί33’13”W, 227.67’ to a point of compound curvature; thence –

5.          59.11 feet along the arc of a curve deflecting to the left, having a radius of 154.00 feet, a delta angle of 21Ί59’26” and a chord bearing S 18Ί34’38”E, 58.74 to a point in the sideline of the aforesaid Indian Hollow Road; thence, along said sideline

 

6.          25.47 feet along the arc of a curve deflecting to the left, having a radius of 50.00 feet, a delta angle of 29Ί10’56” and a chord bearing S 68Ί03’41”W, 25.19 feet to the point of BEGINNING

All that certain parcel of land situate, lying and being in the Township of Mendham, in the County of Morris and the State of New Jersey, and being part of an unnamed road located as an extension of Indian Hollow Road ( formerly Lenape Way) 50 feet wide as shown on Sheet Number 31 of the Official Tax Map of the Township of Mendham and being more particularly bounded and described as follows to wit:

BEGINNING at the intersection of the centerline of said unnamed road and the westerly sideline of Indian Hollow Road ; 3,461.15 feet measured along said sideline and the extension of said sideline from the southerly sideline of Green Hills Road (formerly Stone Axe Road ) thence; along said centerline the following two courses

1.         59.11 feet along the arc of a curve deflecting to the right, having a radius of 154.00 feet, a delta angle of 21Ί59’26” and a chord bearing N 18Ί34’38”W, 58.74 feet to a point of compound curvature; thence -

2.         235.14 feet along the arc of a curve deflecting to the right, having a radius of 268.00 feet, a delta angle of 50Ί16’16” and a chord bearing N 17Ί33’13”E, 227.67 feet to Lot 29; thence; along said lot

3.         S 77Ί07’45”E, 29.32 feet to a point in the westerly line of Lot 62 in Block 142; thence; along said line the following two courses

4.         227.80 feet along the arc of a curve deflecting to the left, having a radius of 243.00 feet, a delta angle of 53Ί42’39” and a chord bearing S 19Ί16’24”W, 219.55 feet to a point of compound curvature; thence –

5.         83.30 feet along the arc of a curve deflecting to the left, having a radius of 129.00 feet, a delta angle of 36Ί59’53” and a chord bearing S 26Ί04’51”E, 81.86 feet to a point in the sideline of the aforesaid Indian Hollow Road; thence, along said sideline

 

6.         46.12 feet along the arc of a curve deflecting to the left, having a radius of 50.00 feet, a delta angle of 52Ί50’45” and a chord bearing S 70Ί55’28”W, 44.50 feet to the point of BEGINNING

CONTAINING: 7,379 S.F, or 0.169 acres of land more or less.

            Section 2.   Pursuant to N.J.S.A. 40:67-21, the Township Clerk be and she hereby is authorized and directed to file, within sixty (60) days after this ordinance shall take effect, a true copy hereof, certified by her under the seal of the Township to be a true copy, together with a copy of the proof of publication hereof, for recording in the office of the Clerk of Morris County, New Jersey in a book entitled “vacations”.

            Section 3.   This ordinance shall take effect after final passage and publication as provided by law.
