ORDINANCE REPEALING SUBSECTION 2-30.8, THE OPEN SPACE TAX SUNSET PROVISION, OF THE MENDHAM TOWNSHIP ORDINANCE CODE

BE IT ORDAINED by the Township Committee of the Township of Mendham , in the County of Morris , New Jersey , as follows:

            Section 1.        By referendum adopted on November 4, 2003 , the Mendham Township voters repealed the “sunset” provision which terminated the Township’s open space tax on December 31, 2008 .  Accordingly, subsection 2-30.8, relating to the Township’s open space tax and entitled “Termination at December 31, 2008 ”, of The Revised General Ordinances of the Township of Mendham , 1998, is hereby repealed.  The Township’s open space tax shall continue as currently authorized by prior voter referenda unless modified or repealed by subsequent voter referendum.  The Township’s Open Space Trust Fund and Open Space Trust Committee shall continue as authorized by Section 2-30 of the Township’s ordinance code unless modified or repealed by subsequent ordinance.
